Liability Waiver and Assumption of Risk Agreement

This Liability Waiver and Assumption of Risk Agreement (the "Agreement") outlines the terms and conditions for participation in programs and activities conducted by Straight Path Athletics ("SPA," "we," "our," or "us"). By participating in SPA programs, you (the "Participant" or "Parent/Guardian") acknowledge and agree to the terms specified in this waiver.
1. Acknowledgment of Waiver and Release
By participating in any program or activity conducted by SPA, I acknowledge that I am enrolling my child (the “Participant”) and fully understand the nature of these programs, including any inherent risks of physical injury or property damage. I acknowledge that by participating, I voluntarily assume all risks associated with the Participant’s participation, including, but not limited to, physical injuries, accidents, or other unforeseen hazards.I release and hold harmless SPA, its officers, directors, employees, agents, volunteers, affiliates, and any third-party providers of facilities or services (“Released Parties”) from any and all claims, demands, causes of action, or liability for injury, illness, death, loss, or damage resulting from participation in any SPA activities, whether caused by negligence or otherwise.
2. Program Registration and Participation
Registration: To participate in SPA programs, registration must be completed online via our official website or on provided forms. Registration is confirmed only upon the submission of the full registration form, acceptance of all waivers, and payment of the non-refundable registration fee.SPA Discretion: SPA reserves the right to accept or reject any registration at its sole discretion, including for reasons of space limitations, behavior concerns, or other factors deemed necessary by SPA.
3. Payment Policy
Payment Methods: Payments are accepted via Credit Card/Stripe. Non-Refundable Fees: All registration fees are non-refundable unless SPA cancels the program. No refunds will be issued for missed practices, games, personal conflicts, injuries, or voluntary withdrawals. In the case of program cancellation by SPA, a refund or credit may be issued at SPA's discretion.
4. Code of Conduct
Expected Conduct: Participants, parents, and guardians are expected to demonstrate respect and good manners (Adab) at all times, both on and off the field. This includes treating coaches, staff, volunteers, other participants, and opponents with dignity and respect.Violation of Conduct: SPA reserves the right to remove any participant or family from the program for violations of the Code of Conduct, without refund.
5. Assumption of Risk
Inherent Risks: Participation in sports and athletic activities involves inherent risks, including but not limited to physical injury, accidents, or illness.Acknowledgment: By participating in SPA programs, I, as the parent/guardian, acknowledge and accept all risks associated with my child’s participation. SPA and its representatives are released from any liability regarding injuries, accidents, or losses arising from participation.
6. Media Consent
Photo/Video Release: By enrolling in SPA programs, I grant SPA the right to photograph, record, and use images or video of my child for promotional, educational, and organizational purposes. If I do not consent to this, I will notify SPA in writing during the registration process.
7. Privacy and Data Protection
Information Security: Personal information provided during registration will be collected, stored, and processed according to SPA’s Privacy Policy. SPA will not sell, share, or distribute this data to third parties without explicit consent. SPA values the Amanah (trust) and upholds confidentiality and security of all participant data.
8. Program Changes and Cancellations
Program Modifications: SPA reserves the right to modify schedules, locations, and structures of programs if necessary. Changes may occur due to weather, facility availability, public health concerns, or other unforeseen circumstances.Cancellation: In the event of full program cancellation, a refund or credit may be issued at SPA’s discretion.
9. Intellectual Property
Ownership: All materials, including logos, designs, text, and program content, are the intellectual property of SPA. No content may be copied, reproduced, or modified without prior written consent from SPA.
10. Limitation of Liability
No Liability for Damages: To the maximum extent permitted by law, SPA disclaims any liability for damages arising from participation in SPA programs or use of the SPA website, including any indirect, incidental, or consequential damages.
11. Governing Law and Amendments
Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of laws principles.

Changes to Terms: SPA reserves the right to update or modify these Terms of Service at any time. Changes will take effect immediately upon posting on the website. Continued participation in SPA programs after changes constitutes acceptance of the revised Terms.
